Define the relevant time

A client may need to know the rule today or the rule that applied to an earlier transaction. Record the event date and the precise legal question.

Do not assume that the current code text resolves every historical issue. Identify the version and timing analysis needed.

Record the statute, section, amendment, and relevant official source. For federal code research, the Office of Law Revision Counsel is an official starting point.

Keep enacted text, codified text, regulations, and proposed changes distinguishable. A bill or proposed rule is not automatically the operative law.

Test a delayed effective provision

Suppose a summary refers to a recent amendment without discussing when it applies. Locate the effective-date and transition language before applying it to the client's event.

Record the source of the timing conclusion. The date on a web page is not a substitute for the legal provision.

Follow cross-references to regulations, definitions, or exceptions relevant to the issue. State any material not located or not yet verified.

Have the responsible lawyer assess application to the facts. AI assistance can organise the sources but should not fill gaps with an assumed timetable.

Preserve the research record

Give the reader the proposition, version, relevant dates, supporting text, and assumptions. Keep historical and current conclusions separate where both are needed.

When updating the memo, explain the substantive change rather than merely refreshing its date. This helps colleagues understand which prior advice may require reconsideration.
